TERMS OF USE - CT CABS

Please read these Terms of Use ("Terms") carefully before using the CT Cabs website (the "Service") operated by Deepak Kumar ("Owner," "we," "us," or "our").

  1. 1. Acceptance of Terms

    By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service.

  2. 2. Services Provided

    CT Cabs is committed to providing safe, smooth, and satisfying cab services, including city commutes, airport transfers, and outstation trips, as described in our "About Us" section. The Service provides a platform for users to:

    • View information about CT Cabs' services.

    • Book and manage cab reservations.

    • Access customer support contact information.

  3. 3. User Accounts
    • Registration

      To use certain features of the Service (e.g., booking a cab), you may be required to create an account. You must provide us with information that is accurate, complete, and current at all times.

    • Security

      You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

    • Notification

      You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

    • Age

      By using the Service, you represent that you are at least 18 years of age or accessing the Service under the supervision of a parent or legal guardian.

  4. 4. Booking, Fares, and Payment
    • Booking Confirmation

      A booking is considered confirmed only upon receipt of a confirmation notice (via app, website, SMS, or email) from CT Cabs.

    • Fares

      Fares displayed on the website are estimates and may be subject to change based on actual travel distance, time, waiting charges, toll/parking fees, surcharges, or other applicable governmental levies.

    • Payment

      All payments must be made through the methods specified by CT Cabs (e.g., online payment, cash, mobile wallets). You agree to pay all applicable charges for the services booked.

    • Cancellation

      Cancellation policies, including potential cancellation fees, are detailed in Section 5 and will be displayed during the booking process.

  5. 5. Tariff and Extra Charges

    The following provisions govern the calculation of all charges related to your trip:

    • a) Tolls, Parking, and Taxes

      All road toll fees, parking charges, state taxes, etc., are charged extra and must be paid to the involved government authorities or the driver according to actuals. These charges will not be included in the CT Cabs trip charge, and CT Cabs is not responsible for receipts that may not be obtained during the journey. Note that a handling charge may be a portion of the receipt you receive.

      • All excess charges based on your utilization for KM or hours over the initial reservation will include the levy of related GST. The applicable price for every extra KM and/or Hour are shared in the confirmation voucher.

      • In case of pick-up from the airport, if the driver has been parked in the airport car parking or if the airport levies a pickup fee (for example, at certain airports), the airport charges must be paid to the involved government authority according to actuals. Please accumulate the receipt directly from the authorities or your driver as CT Cabs will not be responsible for this receipt.

    • b) Trip Duration and Route

      The number of days for the excursion will be calculated on the basis of calendar days and not 24 hours from the pick-up moment. Please return by 23:59 on the final day of your trip. Any postponement will involve more daily prices.

      The distance displayed for your trip is dependent on the maximum efficiency/shortest path. The route accepted during the journey may vary due to your preference or needs, or due to circumstances outside our control (e.g., floods/route changes). You will be charged further with regard to state taxes, kilometers, and cost so predicated on this new path that is taken.

    • c) Hour-Based Bundles

      For services with Hour-based bundles, if the journey extends past the bundled hours, fees will be added for each additional Hour. The additional Hour charges are shared in the confirmation voucher and include the levy of related GST.

      • You will be charged for the KM cited in the confirmation voucher, even if the usage is lower.

      • There is no local usage enabled within the city of origin outside of getting out of the city at the time of pickup and returning to the drop-off location at the end of the trip. This is irrespective of the fresh KM you may have.

    • d) State Taxes

      The nation taxes shown at the time of booking are based on the latest information we have. These charges are subject to change by State authorities without advance notice. Thus, it is possible these may vary for the path following your booking. You would be charged depending upon the latest applicable taxes. We will try our best to share these changes with you as soon as possible, but we are unable to guarantee constant notification. Please cooperate with the driver in such scenarios.

    • e) Night Driving Charges

      For driving between 10:00 pm to 6:00 am on any of the nights, an additional allowance will be applied and is to be paid to the driver. The applicable allowance for each such night is mentioned in your reservation confirmation email and is subject to applicable GST.

      • The total distance will be calculated based on the exact distance from the pick-up point and right back to the pick-up point. Hence, the exact length from your drop-off location to the pickup location will be added to your usage if they are different.

      • You will be billed for extra KM if the application exceeds the initial booking KM. Any applicable Toll and State taxes for the return excursion (right back to the pickup area) are also appropriate and need to be paid to the driver at the drop-off position when the trip is concluded. The extra KM charged will consist of the levy of related GST.

  6. 6. Cancellations and Changes to Itinerary
    • a) CT Cabs Right to Cancel

      CT Cabs reserves the right to cancel the excursion with a minimum 4 hours of advance notice in the event of emergencies or external conditions beyond CT Cabs' control (e.g., local strikes, bandh, curfews, natural calamities, or an unsupported pick-up locale).

    • No Show

      If the reservation is cancelled over 6 hours prior to the chosen time or you do not appear at the specified pickup place with no previous intimation to CT Cabs, the booking will be considered a "No Show." In this situation, CT Cabs reserves the right to deduct an appropriate amount up to 100% of the advance cost to compensate the driver partner for their business loss.

    • b) Vehicle Breakdown and Alternative

      While we take great efforts to maintain our vehicles, a breakdown is still a possibility. In this case, we will do our best to offer a replacement within one hour. The driving time for the alternative vehicle to reach your position would likely be in addition to this one hour.

      • If you opt not to wait for the alternative vehicle or if we are unable to find an alternative, we will settle for the excursion finished so far in accordance with the following terms.

      • Any requested change to the itinerary will be subject to vehicle availability, city/location feasibility, and existing premiums. CT Cabs reserves the right to enable or disable these changes. (For instance, Rohtang Pass requires a specific license that must be obtained in advance). If a city/location add-on is enabled, it may require additional charges.

    • c) Breakdown Compensation (>100 KM)

      In case the breakdown has occurred more than 100 KM from you boarding the cab, you will be given a 50% discount on the kilometers for the inconvenience caused. You must then pay the driver for the 50% kilometers hauled at the rate of the surplus kilometers offered on your voucher. This is to manage a portion of the costs incurred by the driver for the excursion.

    • d) Breakdown Compensation (<100 KM)

      In case the breakdown has taken place within 100 KM of you boarding the cab, you will not be charged for anything.

    • e) Customer Cancellations

      In the event of a change of plans, please cancel the reservation 24 hours beforehand.

      Crucially, we do not encourage cancellations by way of our website or by means of email address. Please contact the call center at 9311039011 or email Info@ctcabs.com to proceed with cancellation.

  7. 7. Dos and Don'ts During the Trip
    • a) Personal Possessions

      By the end of the excursion, remember to check and take your entire possessions. If you have lost your possessions inside the vehicle, we will try our very best to locate those things but are not responsible for the damage or loss.

    • b) Driver Reimbursement

      Any excess cash you have given to the driver should be collected from the driver by yourself. CT Cabs will not be responsible for these reimbursements.

    • c) AC Malfunction

      While a detailed check is always done, in the rare event the AC ceases working due to a mechanical issue, you will get a discount of Rs 1 per KM for the KM traveled without the AC. The driver will try his best to get the AC repaired as soon as possible during the trip.

    • d) Pick-up/Drop-off Points

      You will be picked up at one spot and dropped off at one spot. Multiple pick-ups and drop-offs in the city of origin are not authorized. It is at the sole discretion of CT Cabs to allow them. If enabled, there may be additional charges.

    • e) Vehicle Damage

      CT Cabs reserves the right to charge the customer for any deliberate or accidental damage carried out to the exterior or interior of the car.

    • f) Prohibited Activities

      Drinking and Smoking is strictly prohibited inside the car. You are required to ask the motorist to stop the vehicle for your smoking breaks.

    • g) Driver Breaks/Accommodation

      The driver may require periodic tea-breaks and meal-breaks, which are coordinated directly with him. For multi-day excursions, while most accommodations and resorts provide washrooms for drivers, many do not. If yours does not, you should cooperate with the driver to allow him to freshen up at a nearby place that can be found.

    • h) Vehicle Model

      The reservation will be for the auto type selected, and we do not commit ourselves to providing a preferred car model. For example, if your chosen vehicle type is 'Toyota Etios or equivalent,' any of the equivalent car models such as Toyota Etios, Suzuki Dzire, Mahindra Verito, Hyundai Accent, etc., will be provided based on availability.

    • i) AC on Hills

      AC will be switched off while driving in hilly places. This is to ensure that the engine has sufficient capability to climb the hill.

  8. 8. User Obligations and Conduct (Original Section 5)

    You agree not to use the Service:

    • For any unlawful purpose or in violation of any local, state, national, or international law.

    • To solicit others to perform or participate in any unlawful acts.

    • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

    • To transmit any virus or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.

    • In a way that could damage, disable, overburden, or impair the website or interfere with any other party's use of the website.

  9. 9. Intellectual Property (Original Section 6)

    The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Deepak Kumar and CT Cabs. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CT Cabs.

  10. 10. Limitation of Liability (Original Section 7)

    In no event shall CT Cabs, nor its Owner, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

    • Your access to or use of or inability to access or use the Service.

    • Any conduct or content of any third party on the Service.

    • Any unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

  11. 11. Indemnification (Original Section 8)

    You agree to defend, indemnify, and hold harmless CT Cabs and its Owner, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

    • Your use and access of the Service, by you or any person using your account and password.

    • A breach of these Terms.

  12. 12. Governing Law (Original Section 9)

    These Terms shall be governed and construed in accordance with the laws of Delhi, without regard to its conflict of law provisions.

  13. 13. Changes to Terms (Original Section 10)

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
